My apology for reverting to this subject is a recent article by Mr. W. C. F. Walters in the April number of the Classical Quarterly for 1910 on the signatures in the Vatican Codex . Mr. Walters does not seem to have been aware that this manuscript, though not of direct value in the constitution of the text of Livy, is one whose interest from a palaeographical point of view has long been recognized. A number of articles have been written (...) concerning it, most of which deal with the signatures, the subject of Mr. Walters' paper, more fully and more accurately than he has done. Beyond giving the signatures, two of them incorrectly, Walters does nothing more than to conclude that there were eight scribes, who copied 42 quaternions. But a great deal more than this is known about the scribes and the manuscript. In fact, thanks to the ingenious combinations of Chatelain and Traube in piecing together the hints suggested by the signatures, more is known about this particular manuscript and the circumstances under which it was made than is the case with any other manuscript of a classical author of so early a date. It may therefore be worth while to summarize the known data concerning the manuscript, with a brief account of how they were worked out, referring the reader for the details to the articles mentioned in the footnotes. We present a formal, mathematical model of argument structure and evaluation, taking seriously the procedural and dialogical aspects of argumentation. The model applies proof standards to determine the acceptability of statements on an issue-by-issue basis. The model uses different types of premises (ordinary premises, assumptions and exceptions) and information about the dialectical status of statements (stated, questioned, accepted or rejected) to allow the burden of proof to be allocated to the proponent or the respondent, as appropriate, for each premise separately. Our approach allows the burden of proof for a premise to be assigned to a different party than the one who has the burden of proving the conclusion of the argument, and also to change the burden of proof or applicable proof standard as the dialogue progresses from stage to stage. Useful for modeling legal dialogues, the burden of production and burden of persuasion can be handled separately, with a different responsible party and applicable proof standard for each. Carneades enables critical questions of argumentation schemes to be modeled as additional premises, using premise types to capture the varying effect on the burden of proof of different kinds of questions. This paper describes one way in which a precise reason model of precedent could be developed, based on the general idea that courts are constrained to reach a decision that is consistent with the assessment of the balance of reasons made in relevant earlier decisions. The account provided here has the additional advantage of showing how this reason model can be reconciled with the traditional idea that precedential constraint involves rules, as long as these rules are taken to be defeasible. (...) The account presented is firmly based on a body of work that has emerged in AI and Law. This work is discussed, and there is a particular discussion of approaches based on theory construction, and how that work relates to the model described in this paper. (shrink)

In this paper, I examine Kant's famous objection to the ontological argument: existence is not a determination. Previous commentators have not adequately explained what this claim means, how it undermines the ontological argument, or how Kant argues for it. I argue that the claim that existence is not a determination means that it is not possible for there to be non-existent objects; necessarily, there are only existent objects. I argue further that Kant's target is not merely ontological arguments as such (...) but the larger ‘ontotheist’ metaphysics they presuppose: the view that God necessarily exists in virtue of his essence being contained in, or logically entailed by, his essence. I show that the ontotheist explanation of divine necessity requires the assumption that existence is a determination, and I show that Descartes and Leibniz are implicitly committed to this in their published versions of the ontological argument. I consider the philosophical motivations for the claim that existence is a determination and then I examine Kant's arguments in the Critique of Pure Reason against it. (shrink)

Social norms have played a key role in the evolution of human cooperation, serving to stabilize prosocial and egalitarian behavior despite the self-serving motives of individuals. Young children’s behavior mostly conforms to social norms, as they follow adult behavioral directives and instructions. But it turns out that even preschool children also actively enforce social norms on others, often using generic normative language to do so. This behavior is not easily explained by individualistic motives; it is more likely a result of (...) children’s growing identification with their cultural group, which leads to prosocial motives for preserving its ways of doing things. As research in the areas of unethical and ethical leadership grows, we note the need for more consideration of the normative assumptions in the development of constructs. Here, we focus on a subset of this literature, the “dark side” of supervisory behavior. We assert that, in the absence of a normative grounding, scholars have implicitly adopted different intuitive ethical criteria, which has contributed to confusion regarding unethical and ethical supervisory behaviors as well as the proliferation of overlapping terms and fragmentation (...) of research. Accordingly, we offer a definition of unethical supervision grounded in the normative theories and develop a framework of unethical supervision by analyzing the constructs associated with unethical supervision from a normative perspective. Our analysis suggests a heavy emphasis on violations of the right to dignity. We also note that utilitarianism and certain forms of rights as well as justice have been largely overlooked in the unethical supervision literature. We conclude by considering the implications of our conceptualization for theory on the antecedents and consequences of unethical supervision and by explaining how our approach extends to the larger literature on unethical and ethical leadership. Shishkin, leading Soviet philosopher, major specialist in the field of ethics, one of the oldest and at the same time most active members of the editorial board of our journal. The editors sincerely congratulate Aleksandr Fedorovich on this anniversary and wish him further successes in his work, firm health, and long years of life.

The quantum theory of atoms in molecules (QTAIM) uses physics to define an atom and its contribution to observable properties in a given system. It does so using the electron density and its flow in a magnetic field, the current density. These are the two fields that Schrödinger said should be used to explain and understand the properties of matter. It is the purpose of this paper to show how QTAIM bridges the conceptual gulf that separates the observations of chemistry (...) from the realm of physics and do so in a manner that is both rigorous and conceptually simple. Since QTAIM employs real measurable fields, it enables one to present the findings of complex quantum mechanical calculations in a pictorial manner that isolates the essential physics. The time has arrived for a sea change in our attempts to predict and classify the observations of chemistry, time to replace the use of simplified and arbitrary models with the full predictive power of physics, as applied to an atom in a molecule. The treatment decisions of competent adults, especially treatment refusals, are generally respected. In the case of minors something turns on their age, and older minors ought increasingly to make their own decisions. On the other hand, parents decide on behalf of infants and young children. Their right to do so can best be justified in terms of the importance of preserving intimate family relationships, rather than in terms of the child's best interests, although the child's best interests will most often (...) follow from this arrangement. Nevertheless, there are and ought to be legal, ethical, and financial constraints on parental decision making. (shrink)

The editors planned the appearance of this article to coincide with the seventy-fifth birthday of the author, which was to have been marked in December. The issue had already been approved for publication when the sad news came of the sudden death of Aleksandr Fedorovich Shishkin, prominent Soviet philosopher, member of the editorial board of our journal, a remarkable human being, our comrade and friend.

The paper uses questionnaire responses provided by a sample of ethical investors to investigate willingness to sacrifice ethical considerations for financial reward. The paper examines the amount of financial reward necessary to cause an ethical investor to accept a switch from good ethical performance to poor ethical performance. Conjoint analysis is used to allow quantification of the utilities derived from different combinations of ethical and financial performance. Ethical investors are shown to vary in their willingness to sacrifice ethical for financial (...) performance, and hence to display more heterogeneity than the all-encompassing ‘ethical’ label implies. Because of the existence of sub-groups of ethical investors with different attitudes towards financial reward, an attempt has been made to associate observable investors’ characteristics with their level of willingness to trade-off morality for cash. One sub-group of investors in particular appears highly resistant to the idea of accepting higher financial return as compensation for poor ethical performance. This unwillingness casts doubt on Jensen and Meckling’s widely reported claim that trade-off behaviour is ubiquitous in all areas of life. (shrink)

In response to the fall of Constantinople in 1453, Nicholas of Cusa wrote De pace fidei defending a commitment to religious tolerance on the basis of the notion that all diverse rites are but manifestations of one true religion. Drawing on a discussion of why Nicholas of Cusa is unable to square the two objectives of arguing for pluralistic tolerance and explaining the contents of the one true faith, we outline why theological pluralism is compromised by its own meta-exclusivism.

Structuralism about mathematical objects and structuralist accounts of physical computation both face indeterminacy objections. For the former, the problem arises for cases such as the complex roots i and \, for which a automorphism can be defined, thus establishing the structural identity of these importantly distinct mathematical objects. In the case of the latter, the problem arises for logical duals such as AND and OR, which have invertible structural profiles :369–400, 2001). This makes their physical implementations indeterminate, in the sense (...) that their structural profiles alone cannot establish whether a given physical component is an AND-gate or an OR-gate. Doherty has recently shown both problems to be analogous, and has argued that computational structuralism is threatened with the absurd conclusion that computational digits might be indiscernible, such that, if structural properties are all that we have to go on, the binary digit 0 must be treated as identical to the binary digit 1. However, we think that a solution to the indiscernibility problem for mathematical structuralists, drawing on the work of David Hilbert, can be adapted for the analogous problem in the computational case, thereby rescuing the structuralist approach to physical computation. Many scholars and activists favor banning illicit businesses, especially given that such businesses constitute a large part of the global economy. But these businesses are commonly operated as if they are subject only to the ethical norms their management chooses to recognize, and as a result they sometimes harm innocent people. This can happen in part because there are no effective legal constraints on illicit businesses, and in part because it seems theoretically impossible to dispose definitively of arguments that support (...) moral relativism. Progress is being made, however, towards a “second best” arrangement consisting of widespread institutional agreements regarding ethical norms. This development might eventually enable us to transcend moral relativism in some respects. Indeed, although some business ethicists who examine illicit business practices accept moral relativism, others attempt to surmount it. The latters’ endeavor, I show, is cross-cultural in nature in that it involves businesses that are deemed illicit in at least one but not every culture. I then recall some traditional solutions and their limits: ideological teachings are culture-specific, hence both temporally and spatially limited; legal constraints, though potentially helpful, are too diverse hence often narrow in reach. Especially problematic are defense industry businesses, which are inherently transcultural and, though uniquely harmful, are not effectively banned in any culture. Harm to quality of life (QoL) can, however, be measured. So I recommend institutional support for international human rights tied to QoL data as a workable way to counter moral relativism regarding illicit businesses. (shrink)

Context: Society is faced with “wicked” problems of environmental sustainability, which are inherently multiperspectival, and there is a need for explicitly constructivist and perspectivist theories to address them. Problem: However, different constructivist theories construe the environment in different ways. The aim of this paper is to clarify the conceptions of environment in constructivist approaches, and thereby to assist the sciences of complex systems and complex environmental problems. Method: We describe the terms used for “the environment” in von Uexküll, Maturana & (...) Varela, and Luhmann, and analyse how their conceptions of environment are connected to differences of perspective and observation. Results: We show the need to distinguish between inside and outside perspectives on the environment, and identify two very different and complementary logics of observation, the logic of distinction and the logic of representation, in the three constructivist theories. Implications: Luhmann’s theory of social systems can be a helpful perspective on the wicked environmental problems of society if we consider carefully the theory’s own blind spots: that it confines itself to systems of communication, and that it is based fully on the conception of observation as indication by means of distinction. In the philosophy of science, abstraction has usually been analyzed in terms of the interface between our experience and the design of our concepts. The often implicit assumption here is that such interface has a definite identifiable and universalizable structure, determining the epistemic correctness of any abstraction. Our claim is that, on the contrary, the epistemic grounding of abstraction should not be reduced to the structural norms of such interface but is also related to the constraints on the cognitive processes (...) of specific abstractions. This suggests that we should understand abstraction as embodied in different kinds of abstraction practices. (shrink)

Business ethicists should examine ethical issues that impinge on the perimeters of their specialized studies (Byrne 2011 ). This article addresses one peripheral issue that cries out for such consideration: the international resource privilege (IRP). After explaining briefly what the IRP involves I argue that it is unethical and should not be supported in international law. My argument is based on others’ findings as to the consequences of current IRP transactions and of their ethically indefensible historical precedents. In particular I (...) examine arguments from political philosophy for more equitable distribution of resources and appeals to property rights as a means of achieving this; business ethicists’ critiques of contemporary resource appropriations; and legal historians’ accounts of despoliation of aboriginal peoples, especially in what is now the United States, involving acquisition via conquest, asserted jurisdiction, and religious and racial preeminence. I also consider relevant human rights’ standards; supportive views of some theorists, especially early modern realists and current supporters of group rights and multidimensional rectification; some de facto incidences of substantive restitution; and proposals for effecting further rectification. Some parents have taken steps to ensure that they have deaf children, a choice that contrasts with the interest that other parents have in enhancing the traits of their children. Julian Savulescu has argued that, morally speaking, parents have a duty to use assisted reproductive technologies to give their children the best opportunity of the best life. This view extends beyond that which is actually required of parents, which is only that they give children reasonable opportunities to form and act (...) on a conception of a life that is good for them. Does the selection of deaf children violate that responsibility? Morally speaking, parents should refrain from using assisted reproductive treatments or prenatal interventions in order to have a child with a disability. Deafness and other disabilities represent intrinsic disadvantages that cannot be offset by other advantages that families and society can offer to people. By the same token, neither should parents seek enhancements of intelligence or physical traits that would undercut intrinsic goods of human life in similar ways. These moral arguments do not, however, sustain the judgment that the law should necessarily interfere with parents' decisions in these matters, even if those choices are morally unwise. (shrink)

Participants in conferences organized by the editors of our journal have repeatedly expressed the desire that questions pertaining to the ethics of the scientist be examined in its pages.

Findings in dynamic unit formation suggest that completion processes reflect the optics of our world. Dynamic unit formation may depend on patterns of motion signals that are consistent with the causes of optical changes. In addition, dynamic completion conforms to a local curvature minimization constraint. Such relational aspects of vision are important to consider in linking perceptual experience and neural activity.

This problem was not the subject of any single book or article of Lenin's. However, in his writings , Lenin often had to deal with this problem and to elucidate significant aspects of it. We believe it necessary, to the degree that is possible within the confines of an article, to examine Lenin's major postulates with respect to this problem, bearing in mind not only the constant need to study this great heritage but also the fact that Lenin's postulates on (...) cognition and evaluation are of current importance in connection with present discussions on questions closely related to this.
